Why Certain Work Continues During Extreme Fire Danger

Lookingglass Rural Fire District (LRFD) would like to address a situation that occasionally causes confusion within the community.
At times, LRFD is dispatched to reports of individuals performing work that may appear to be in violation of current fire regulations. Our crews arrive, confirm there is no immediate fire risk, and then leave — while the work continues.
Why This Happens
There are legitimate reasons why certain activities may continue during fire restrictions:
- Agricultural Exemptions: Agricultural work is exempt from many fire regulations, even during EXTREME fire danger. However, individuals performing such work can still face fines or be required to pay suppression costs if a fire starts as a result of their activities.
- DFPA Waivers: The Douglas Forest Protective Association (DFPA) can issue waivers permitting certain types of work. For a waiver to be issued, DFPA must inspect the site, verify that proper fire suppression resources are present, and determine that the work can be done safely.
Important: LRFD does not issue waivers — only DFPA can authorize them.
LRFD’s Role and Authority
Many community members have asked why LRFD does not issue citations for regulation violations. LRFD does not have the authority to cite individuals. Our priority is public safety, and our preferred approach is to educate rather than fine. In many cases, those found to be in violation are unaware of the regulations in place.
If violations continue or if suppression efforts become necessary, LRFD can request assistance from DFPA or the Douglas County Sheriff’s Office. Either agency can issue citations when appropriate. In most cases, DFPA is automatically dispatched to all reported regulation violations or natural cover fires and will conduct their own investigation. DFPA will determine whether education or enforcement is necessary.
